Amends Section 63-11-30 to establish that operating a motor vehicle in violation of implied consent laws (driving under the influence) and causing another person's death in a negligent manner constitutes capital murder.

Adds a new capital murder provision for DUI deaths that requires persons charged with causing death while driving under the influence to post bail before release after arrest.

Establishes that causing the death of a child under age 16 while driving under the influence also constitutes capital murder, in addition to existing felony penalties for endangering a child by DUI.

Amends Section 97-3-19 to add violations of the new DUI capital murder statute (Section 63-11-30(5)(b)) as a capital offense.

Amends Section 99-19-101 to designate DUI-related deaths as an aggravating circumstance in capital sentencing proceedings; effective July 1, 2013.
