Prohibits any person from operating a motor vehicle on a public road, street, or highway while using a wireless communication device to send or receive a written message.

Defines "wireless communication device" as any device using commercial mobile service, including cellular telephones and personal digital assistants.

Exempts law enforcement, emergency vehicles, persons reporting reckless behavior, persons in physical danger, parked vehicles, emergency communications, vehicle operational systems, and vehicle navigation systems from the prohibition.

Violations are misdemeanors punishable by a fine not exceeding $500, or up to $1,000 if the violation occurs during a motor vehicle accident.

Law enforcement must document any violations of this section on written accident reports.
