HB 1557 Summary

• Creates the Mississippi Smokefree Air Act of 2013, establishing comprehensive prohibitions on smoking in enclosed public places, places of employment, private clubs, and certain outdoor areas to protect public health from secondhand smoke exposure.

• Prohibits smoking in all enclosed public places including bars, restaurants, health care facilities, educational facilities, gaming facilities, and retail establishments, and in all enclosed areas of workplaces without exception.

• Prohibits smoking in outdoor areas within 20 feet of building entrances, windows, and ventilation systems; in outdoor seating areas of restaurants and bars; on playgrounds; and in outdoor workplaces where two or more employees are present.

• Requires property owners and managers to post "No Smoking" signs at entrances and remove ashtrays from prohibited areas; establishes penalties of $50 fine for individuals who smoke in violation and $100-$500 fines for owners/managers who fail to comply.

• Repeals the existing Mississippi Clean Indoor Air Act (Sections 29-5-160 through 29-5-163) and takes effect July 1, 2013; allows local governments to adopt more restrictive ordinances and permits private citizens and employees to pursue legal enforcement including injunctive relief.
