Amends Section 77-3-21 of the Mississippi Code to require the Public Service Commission to determine whether a qualified public water authority's certificate of public convenience and necessity should be cancelled before a municipality can exercise eminent domain over water or sewer system facilities in the certificated area

Establishes that municipalities must obtain a Public Service Commission determination to cancel a utility's certificate before seizing water or sewer infrastructure through eminent domain powers under Section 77-3-17

Applies the same certificated area protections to water and sewer utilities that currently apply to other utility providers

Takes effect July 1, 2013
