Amends Section 83-17-71 to authorize the Insurance Commissioner to suspend or revoke an insurance producer's license or impose civil penalties up to $1,000 per violation for violating Section 103 of the Medicare Improvements for Patients and Providers Act of 2008 or CMS regulations on Medicare Advantage and Prescription Drug plan marketing activities.

Creates new Section 83-17-72 establishing that insurance producers who violate federal Medicare marketing restrictions commit a misdemeanor punishable by fines between $500 and $5,000, imprisonment up to six months in county jail, or both.

Penalties collected under the civil provisions shall be deposited into the Insurance Department Fund.

Takes effect July 1, 2013.
