Amends Section 37-3-9, Mississippi Code of 1972, to change the appointment process for the State Superintendent of Public Education from the State Board of Education to the Governor, subject to Senate advice and consent.

Changes the entity responsible for establishing the State Superintendent's salary from the State Board of Education to the State Personnel Board.

Requires the State Superintendent to serve at the Governor's will and pleasure rather than the State Board's will and pleasure.

Shifts administrative oversight of the State Department of Education from policies established by the State Board of Education to policies established by the Office of the Governor.

Takes effect July 1, 2013, contingent upon ratification of Section 202 of the Mississippi Constitution of 1890 as amended by House Concurrent Resolution No. ____, 2013 Regular Session.
