Prohibits municipalities from exercising eminent domain over water and sewer facilities of qualified public water authorities in certificated areas unless the Mississippi Public Service Commission cancels the certificate of public convenience and necessity.

Expands the definition of "qualified corporation" and "project" to explicitly include sewer services in addition to water services, allowing water authorities to provide both water and sewer services.

Exempts not-for-profit water authorities and qualified corporations from Mississippi Public Service Commission rate regulation for water and sewer services.

Amends Section 77-3-13 to require the Public Service Commission to determine whether certificates should be cancelled before any public agency acquires service areas or operating rights from regulated utilities.

Effective date: July 1, 2013.
