House Bill 806 Summary

• Creates the Mississippi Administrative Law Procedures Act to replace existing administrative procedures law, effective July 1, 2013, establishing comprehensive rules for agency operations, rulemaking, and public access to records.

• Requires agencies to make information publicly available including organizational descriptions, rules, procedures, final opinions, and administrative records; establishes procedures for public requests for records with 20-day response deadlines and fee limitations.

• Mandates agencies maintain systems of records with privacy protections, allow individuals to access and amend personal records, and prohibit unauthorized disclosure of individually identifiable information under penalty of fines up to $5,000.

• Establishes procedures for agency rulemaking including public notice and comment periods, requires submission of major rules to the Legislature for 60-day review period, and allows the Legislature to disapprove rules by joint resolution.

• Provides for agency hearings, judicial review of agency actions, and public meetings requirements for multi-member agencies; prohibits ex parte communications and anonymous complaints in agency proceedings.
