Senate Bill 2078 Summary

• Prohibits smoking in all enclosed public places and places of employment throughout Mississippi, including bars, restaurants, health care facilities, educational institutions, gaming facilities, and public transportation

• Bans smoking in outdoor areas within 20 feet of building entrances, in outdoor seating areas of restaurants and bars, playgrounds, public transportation stations, and outdoor workplaces where two or more employees are present

• Prohibits smoking in all private clubs and in enclosed residential facilities including nursing homes and hotel/motel guest rooms

• Establishes penalties for violations: infraction fines up to $50 for individuals who smoke illegally and $100-$500 for business owners/managers who fail to comply, with potential suspension or revocation of business licenses for repeated violations

• Repeals the existing Mississippi Clean Indoor Air Act (Sections 29-5-160, 29-5-161, and 29-5-163) and takes effect July 1, 2013
