MS SB2088

Changes the compulsory school attendance age from six (6) years to five (5) years old, requiring kindergarten-age children to attend licensed public, parochial, or nonpublic school kindergarten programs.

Defines "school" for kindergarten-age children as any licensed public, parochial, or nonpublic school kindergarten program that addresses cognitive, social, and emotional needs of five-year-old children.

Applies all provisions of the Mississippi Compulsory School Attendance Law to kindergarten-age children, including enrollment requirements, attendance tracking, and penalties for noncompliance.

Maintains existing exemptions for children who are physically, mentally, or emotionally incapable of attending school; enrolled in special education programs; or in legitimate home instruction programs.

Takes effect July 1, 2013.
