Allows first-time offenders convicted of embezzlement to petition for expunction of the conviction if the embezzled funds or property did not consist of public money or property.

Petitioner must wait five (5) years after successful completion of all sentence terms and conditions before filing for expunction.

Petitioner must provide ten (10) days' written notice to the district attorney before the expunction hearing, and the court may grant the petition if it determines the applicant is rehabilitated.

A nonpublic record of the expunction order is retained by the Mississippi Criminal Information Center only to determine future first-offender status, and law enforcement may retain records for law enforcement purposes.

Effective date is July 1, 2013.
