Real estate licensees are not required to disclose property size or area, and any disclosure provided shall not be considered a warranty or guarantee of accuracy.

When a real estate licensee provides third-party size or area information (from appraisers, surveyors, tax assessors, or builders), the licensee must identify the source of that information.

Real estate licensees have no duty to independently investigate or verify the accuracy of property size or area information and are not liable for conflicting measurements or opinions.

A licensee may only be held liable for damages if they knowingly violate the duty to disclose the information source, and any civil action is limited to actual damages without exemplary or punitive damages.

Civil actions must be commenced within two (2) years after the property transfer, with the prevailing party entitled to court costs and reasonable attorney fees; property transfers cannot be invalidated solely due to non-compliance with this section.
