Persons age 21 and older may make homemade beer for personal, family, domestic, or household use if made in a county or municipality where beer possession is lawful.

Annual production limits are 100 gallons per person for single-adult households and 200 gallons for households with two or more adults over age 21.

Homemade beer may only be transported from the home to participate in bona fide exhibitions, contests, or competitions where beer is tasted and judged; sale of homemade beer is prohibited.

Sections 67-3-7, 67-3-13, and 67-3-15 are amended to clarify that homemade beer transport is lawful and that the brewing prohibition does not apply to authorized homemade beer production.

The act takes effect July 1, 2013.
