Authorizes the Department of Mental Health to contract with private and/or public entities to transfer beds from state-operated Intermediate Care Facilities for the Mentally Retarded to locations operated by other entities.

Allows transferred beds to be placed in settings deemed more appropriate for serving individuals with intellectual disabilities based on their needs.

Specifies that any license for transferred beds remains in the name of the Department of Mental Health and cannot be transferred to the contractor unless the contractor obtains appropriate certificates of need.

Effective July 1, 2013.
