Requires property and casualty insurers to bear the burden of proof by preponderance of the evidence that any policy exclusion applies to a claim or loss in civil actions brought by policyholders under "all perils" coverage policies.

Applies to any civil action alleging an insurer's failure to pay a lawful claim under the policy.

Applies retroactively to all actions filed on or after July 1, 2014, regardless of when the cause of action accrued.

Takes effect July 1, 2014.
