House Bill 1031 Summary

• Amends Mississippi Code Section 93-21-15 to allow temporary domestic abuse protection orders to last up to one year instead of 30 days when the protected party and respondent have no minor children in common.

• Maintains the 30-day maximum duration for temporary domestic abuse protection orders when minor children are involved.

• Allows either party aggrieved by a municipal or justice court decision on a protection order to request de novo review by chancery or county court.

• Requires the Attorney General, Mississippi Supreme Court, and Mississippi Judicial College to develop standardized forms for temporary and final domestic abuse protection orders, effective by July 1, 2015.

• Takes effect July 1, 2014.
