MS HB1061

Expands grandparents' visitation rights by allowing grandparents not authorized under existing law to petition chancery court for visitation rights with grandchildren.

Requires courts to find that the grandparent established a viable relationship with the child and that the parent unreasonably denied visitation before granting rights.

Defines "viable relationship" as: financial support for at least 6 months, frequent visitation with occasional overnight stays for at least 1 year, or significant childcare during parent's incarceration or military duty.

Allows courts to require grandparents to pay reasonable attorney's fees and court costs to parents, unless the court finds no financial hardship would result.

Takes effect July 1, 2014.
