Owners of residences or businesses with operating and properly functioning water wells are not required to connect to public water systems when they become available.

Owners of residences or businesses with operating and properly functioning individual on-site wastewater disposal systems are not required to connect to centralized wastewater treatment systems when they become available.

Licensed professional engineers may issue rulings on whether water wells or wastewater systems are properly functioning, and their determinations take precedence over any state or local governing body decision.

Creates new Section 41-67-8 establishing wastewater disposal system standards and amends existing Sections 41-67-7, 41-67-9, and 41-67-11 to conform with the new provisions.

Effective July 1, 2014.
