House Bill 1280 Summary

• Amends Section 41-7-191 of Mississippi Code to exempt the relocation of existing skilled nursing facilities from certificate of need (CON) requirements when relocating within the same long-term care planning district.

• Exemption applies only if the new facility does not increase the number of authorized nursing home beds, all authorized beds and services are relocated, and the existing building was originally constructed at least 25 years before construction of the replacement building begins.

• Requires the relocating skilled nursing facility to certify compliance with current Minimum Standards for Institutions for the Aged or Infirm issued by the State Department of Health.

• Establishes an administrative fee not to exceed $35,000 payable to the State Department of Health for facilities utilizing this exemption.

• Takes effect July 1, 2014.
