House Bill 1310 - Mississippi Employment Fairness Act

• Creates the Mississippi Employment Fairness Act to prohibit state laws, ordinances, or regulations from requiring employers or employees to waive rights under the National Labor Relations Act.

• Declares any agreement or contract between an employer and labor organization that violates these provisions to be unlawful, null, void, and of no legal effect.

• Prohibits public procurement documents from requiring bidders, contractors, or subcontractors to enter into labor organization agreements, remain union signatories, or require employees to pay union dues exceeding their share of collective bargaining costs.

• Allows bidders, contractors, and employees to seek injunctive relief in Hinds County chancery court to prevent state violations and permits prevailing parties to recover costs and attorney fees.

• Amends Section 31-7-13 regarding public purchasing procedures and brings forward Section 71-1-47 establishing Mississippi's right-to-work public policy; effective July 1, 2014.
