HB 1423 Summary

• Expands the Law Enforcement Officers and Fire Fighters Death Benefits Trust Fund to include coroners and emergency management agency personnel, and increases the death benefit payment from $65,000 to $100,000.

• Combines the separate Death Benefits Trust Fund and Disability Benefits Trust Fund into a single Law Enforcement Officers, Firefighters, Coroners and Emergency Management Agency Personnel Death and Disability Benefits Trust Fund.

• Modifies the disability benefit to be paid from the combined trust fund at 34% of regular base salary for up to 12 monthly payments, limited to the difference between workers' compensation and base salary.

• Provides additional funding for the trust fund by increasing state assessments collected from traffic violations, implied consent law violations, game and fish violations, and other misdemeanor and felony violations.

• Allows the Department of Public Safety to request transfers from the Uninsured Motorist Identification Fund if the Death and Disability Benefits Trust Fund becomes insufficient, and makes the act effective July 1, 2014.
