MS HB1425

Prohibits manufacturing, importing, installing, reinstalling, selling, or offering for sale nonfunctional or counterfeit airbags with knowledge that they do not meet federal safety requirements or federal motor vehicle safety standards.

Defines "nonfunctional airbag" as a previously deployed or damaged airbag, one with electric faults detected after installation, or any part designed to mislead vehicle owners into believing a functional airbag is installed.

Defines "counterfeit airbag" as an airbag displaying a mark identical or similar to a genuine manufacturer's mark without authorization.

Establishes violations as felonies punishable by fines of $1,000 to $5,000 and/or imprisonment up to 3 years, with each manufacture, importation, installation, reinstallation, sale, or offer for sale constituting a separate violation.

Classifies violations as unfair or deceptive trade practices under Mississippi Code Section 75-24-5 and makes the law effective July 1, 2014.
