Each local law enforcement agency must adopt a written policy on investigating deaths resulting from officer involvement, which all officers must sign acknowledging receipt.

Officer-involved deaths and shootings must be investigated by at least two Internal Affairs investigators from outside the officer's employing agency, appointed by the Attorney General.

Traffic-related officer-involved deaths or shootings require investigation by an independent crash reconstruction unit not affiliated with the employing law enforcement agency.

All officer-involved shootings, in-custody deaths, and serious uses of force require immediate response and Internal Affairs investigation regardless of whether a complaint was filed or if a prosecutor declines charges.

Investigations must be completed within six months with a written report provided to the Attorney General and district attorney; if no prosecution is recommended, the report must be released to the public immediately; extensions up to six additional months may be granted by federal court for good cause.
