Allows identity theft victims to send a certified letter to creditors requesting forgiveness of fraudulently incurred debt and removal from credit reports.

If creditor fails to respond within 60 days of receiving the certified letter, victim may petition chancery court in the county where they reside or where the debt was incurred.

Victim's sworn petition must demonstrate they did not incur the debt, did not authorize it, had no knowledge of it, received no benefit from it, and filed a formal police report.

Upon satisfactory proof, the court shall order the creditor to release the victim from all debt obligations and authorize removal of the debt from all credit bureaus.

Effective date: July 1, 2015.
