House Bill 1365 Summary

• Requires drivers or licensed occupants to remove vehicles from public roadways to the shoulder, emergency lane, median, or safe refuge after traffic accidents with no apparent serious injury or death, if the vehicle can be safely moved under its own power.

• Prohibits holding a driver or person liable for causing an accident solely because they moved the vehicle in compliance with this requirement.

• Allows drivers to request any person with a valid driver's license to remove the vehicle on their behalf.

• Does not eliminate drivers' duties to stop, provide information, file written reports with law enforcement, or prevent prosecution for failure to stop and report accidents.

• Becomes effective July 1, 2015; violations are punishable as misdemeanors.
