Uninsured motorists waive the ability to recover noneconomic damages against insured drivers who comply with Mississippi Motor Vehicle Safety-Responsibility Law when the uninsured driver is at fault in the accident.

Definition includes uninsured vehicle owners, permissive drivers, and nonpermissive drivers operating uninsured vehicles.

Waiver does not apply if the accident was caused in whole or in part by a driver operating under the influence of drugs or alcohol, or convicted of manslaughter or simple or aggravated assault.

Uninsured motorists whose previous insurance was terminated or nonrenewed for non-payment are exempt from the waiver if the insurer provided notice of termination at least six months before the accident.

Jury members must not be informed of the waiver or its effect on damages, and passengers in uninsured vehicles retain full rights to recover; effective July 1, 2015.
