Exempts health care facilities damaged by the April 28, 2014 natural disaster from Mississippi's Certificate of Need (CON) Law requirements when repairing or rebuilding within one mile of the original location.

Temporary post-disaster health care facilities may operate within five miles of the pre-disaster location and still qualify for the CON exemption.

Exemption applies only if the facility does not increase bed capacity, change service types, or rebuild in a different county from its pre-disaster operations.

"Significant damage" is defined as damage requiring at least $1,000,000 in expenditures to the health care facility.

Exemption is valid for five years from the Governor's or President's proclamation of a state of emergency, and construction must begin within this period or the exemption becomes inapplicable.
