MS SB2796

Creates the Article V Convention Faithless Delegate Act to establish procedures for appointing delegates to a convention proposing amendments to the U.S. Constitution.

Requires the Legislature to appoint delegates and alternate delegates who must be Mississippi residents and take an oath to follow legislative instructions regarding the convention's scope and permitted amendments.

Prohibits delegates from voting on proposed amendments that differ from the exact text in the application calling for the convention or that fall outside the scope defined by legislative instructions.

Provides for immediate removal of any delegate who violates voting restrictions, with such votes rendered void and replacement by an alternate delegate.

Establishes criminal penalties of up to two years imprisonment and/or a fine of up to $2,000 for delegates who knowingly and willfully violate the restrictions.
