Entities building, constructing, or extending pipelines or appliances for conveying oil, gas, or carbon dioxide must declare on a State Oil and Gas Board form whether they intend to exercise eminent domain, effective July 1, 2016.

Any entity exercising eminent domain to build, construct, or extend a pipeline or appliance must operate it as a common carrier as a condition of exercising that power.

County boards of supervisors retain authority to regulate how pipelines and appliances are constructed and maintained on county highways and bridges.

Pipeline operators remain responsible for damages caused by construction or operation of their lines and appliances.
