Requires municipalities and county boards of supervisors to prepare a timeline for moving public utilities' underground utilities whenever a construction project is permitted.

Gives utilities 60 days to review and comment on the proposed timeline for underground utility removal.

Requires municipality or county and utility to enter into a written agreement within 60 days after the review period, with failure to do so triggering a $500 per day penalty payable to the municipality or county.

Imposes a $500 per day penalty against utilities that fail to meet deadlines specified in the removal agreement, payable to the municipality or county until compliance is achieved.

Requires municipalities or counties to provide utilities 30 days written notice before levying any penalties under this act.
