Justice court judges may order expungement of misdemeanor convictions upon showing of rehabilitation, good conduct for two years since last conviction, and that expungement serves the best interest of society, with prior notice to the county prosecutor.

A person whose record is expunged legally stands as though never convicted and may lawfully respond that they have no prior convictions, though expungement does not affect confidential law enforcement records or driving records under Title 63.

Persons convicted of misdemeanors in justice court before age 23 (excluding traffic violations) who are first offenders may alternatively utilize Section 99-19-71 to expunge such convictions.

The act takes effect July 1, 2016.
