Uninsured and noncompliant motorists may not collect noneconomic damages from insured motorists who are found at fault in motor vehicle accidents.

Exception applies if the compliant insured motorist was operating under the influence of drugs or alcohol, or convicted of manslaughter or assault arising from the accident.

Exemption does not apply to drivers whose insurance was terminated for non-payment if the insurer provided at least six months' notice before the accident.

Awards against noncompliant motorists must be reduced by the noneconomic loss portion, and juries cannot be informed of this waiver or its effect on total recovery.

Passengers in uninsured vehicles and claims for economic losses remain unaffected by this limitation; effective July 1, 2016.
