MS SB2210

Amends Section 11-46-9 of Mississippi Code to clarify that governmental entities and their employees are immune from liability when exercising discretionary acts, functions, or duties, regardless of whether the discretion is abused.

Adds language specifying that discretionary immunity applies even when a discretionary act also furthers a narrower function made ministerial by another statute, ordinance, or regulation.

Maintains existing immunity categories including legislative and judicial actions, police and fire protection duties (unless reckless disregard), tax collection, permit issuance, and school discipline actions.

Preserves immunity for governmental entities that are inactive and dormant with no revenue, employees, or property; immunity terminates if such an entity becomes active.

Effective upon passage.
