Requires private prison contractors to demonstrate their facilities can achieve a recidivism rate at least 10% lower than the recidivism rate of state-run Department of Corrections facilities before entering into contracts

Maintains existing requirements that private contractors must show qualifications, experience, ability to comply with laws and court orders, and a history of successful correctional facility management

Continues the mandate that private prison contracts must provide at least 10% cost savings compared to state-operated facilities

Requires PEER Committee to contract with certified public accountants every two years (starting 2012) to establish and certify the state's inmate cost per day for comparison purposes

Effective date of July 1, 2016, with repeal date of June 30, 2016 (note: these conflicting dates appear to be a drafting error that would effectively nullify the bill)
