SB 2765 Summary

• Creates Section 99-15-131 to allow misdemeanor defendants charged with domestic violence, simple assault, DUI (first or second offense), malicious mischief, petit larceny, uttering forgery, or bad check offenses to participate in pretrial intervention programs with agreement of prosecutor, district attorney, defendant, defense attorney, and court.

• Requires one-year participation period and mandates participants pay $250 court costs, $300 investigative fee per count to investigating agency, district attorney participation fees, and restitution as determined by district attorney.

• Applies existing Pretrial Intervention Act provisions to misdemeanor participants except where specifically modified by the new section.

• Amends Sections 99-15-101, 99-15-103, 99-15-109, 99-15-113, 99-15-117, 99-15-121, and 99-15-123 to extend pretrial intervention act procedures to include misdemeanor participants and references to Section 99-15-131.

• Takes effect July 1, 2016.
