Creates new crime of indecent assault for intentional, non-consensual touching of breast, buttock, inner thigh, groin, genital area, or anal area for sexual gratification purposes.

First or second conviction is a misdemeanor punishable by up to six months in county jail and/or fine up to $500.

Third or subsequent conviction within seven years becomes a felony punishable by up to five years in Department of Corrections and fine up to $5,000.

Exempts spouses or those living as spouses from prosecution under this section.

Effective July 1, 2016.
