HB 1075 Summary

• Reduces the distance requirement for drug offense enhancements near schools from 1,500 feet to 500 feet and limits the enhancement to situations where persons under 18 years of age are reasonably expected to be present.

• Removes sentencing enhancements for drug offenses committed within the reduced 500-foot zone near schools when the offense occurs inside a private residence with no minors present.

• Repeals Section 41-29-147, which provided sentencing enhancements for second drug offense convictions.

• Clarifies parole eligibility for offenders convicted between 1995 and 2014 of controlled substance offenses under Sections 41-29-142 and 41-29-147, allowing them to be paroled after serving one-fourth of their sentence.

• Takes effect July 1, 2017.
