Creates new crime of indecent assault under Mississippi Code Section 97-3-8, defined as knowingly and intentionally touching another person on breast, buttock, inner thigh, groin, genital area, or anal area without consent for sexual gratification purposes.

First or second conviction for indecent assault is a misdemeanor punishable by up to 6 months in county jail and/or a fine of up to $500.

Third or subsequent conviction within 7 years becomes a felony punishable by up to 5 years in the Department of Corrections and/or a fine of up to $5,000.

Does not prevent prosecution under existing sexual offense statutes (Sections 97-5-23 or 97-3-7).

Takes effect July 1, 2017.
