MS HB1370

Amends Section 97-1-7 of the Mississippi Code to revise penalties for attempted capital offenses.

Establishes that attempted murder convictions result in life imprisonment if the jury fixes the penalty at that level, or a minimum of 20 years if the jury fails to agree on life imprisonment.

Prohibits the death penalty from being imposed for any attempted offense conviction.

Requires that penalties for attempted offenses cannot exceed the penalty for the actual commission of the offense.

Takes effect July 1, 2017.
