Amends Section 71-3-71 of the Mississippi Code to modify workers' compensation law regarding third-party lawsuits by injured employees.

Requires deduction of any percentage of fault attributable to the employer for the proximate cause of injuries from net proceeds recovered in third-party actions, in addition to existing deductions for collection costs.

Establishes that the court (or commission in case of settlement without suit) shall determine and deduct the employer's percentage of fault before calculating the employer's repayment entitlement.

Applies the fault deduction to both scenarios: when the employer/insurer joins an employee's third-party action and when the employee independently sues a third party.

Effective date: July 1, 2017.
