Requires hospitals to refer individuals at or near death to organ procurement organizations and mandates searches of the Mississippi Department of Public Safety records and donor registries to determine if the individual made an anatomical gift.

Mandates that procurement organization representatives and attending physicians provide anatomical gift information and seek consent from authorized family members if the individual has no document of gift or refusal, with reasonable discretion and sensitivity to family circumstances.

Requires hospitals, procurement organizations, and attending physicians to maintain detailed records of all consent requests, information provided, and signatures or refusals, with copies placed in the deceased individual's hospital medical records in a form prescribed by the State Department of Health.

Subjects hospitals or physicians who consistently fail to comply with these requirements to disciplinary action from their appropriate licensing agency.

Takes effect March 26, 2017.
