Classifies third or subsequent violations of operating all-terrain vehicles, four-wheel-drive motorized vehicles, or other wheeled or tracked conveyances in public waterway beds as a Class I violation under Section 51-1-4(4)(a).

Penalties for third or subsequent violations include a fine of $3,000 to $5,000, six months imprisonment in county jail, and forfeiture of the vehicle used in the violation.

Amends Sections 49-7-141, 49-7-251, 49-7-253, and 49-7-257 to include references to the new Class I violation and establish forfeiture procedures for vehicles seized under this provision.

First and second violations remain Class II violations subject to existing penalties under Section 49-7-143.

Effective July 1, 2017.
