Removes the prohibition that prevented holders of commercial driver's licenses or commercial learning permits from being eligible for nonadjudication of a first DUI offense.

Maintains all other eligibility requirements for nonadjudication, including successful completion of court-imposed conditions, no prior DUI convictions, and court-approved justification.

Clarifies that individuals must not be operating a commercial vehicle at the time of the offense to qualify for nonadjudication, but does not bar those who hold a commercial license from eligibility.

Takes effect July 1, 2017.
