Private prison contractors must demonstrate by July 1, 2020, the ability to provide incarceration services resulting in a recidivism rate 10% lower than the Mississippi Department of Corrections' recidivism rate for offenders released from their facilities.

Recidivism is defined as conviction of a new felony offense within three years of release from prison, and the department's recidivism rate will serve as the baseline for comparison.

The Mississippi Department of Corrections must collect and report prison, probation, and post-release supervision data including recidivism rates by offense type, risk level, and individual correctional facility.

The department must semiannually report collected data to the Oversight Task Force, Lieutenant Governor, Speaker of the House, and relevant legislative committee chairs for Corrections and Judiciary.

The act takes effect July 1, 2017.
