Health care providers and coroners must notify the Mississippi Bureau of Narcotics of any death caused by drug overdose within forty-eight (48) business hours of receipt of written confirmation of the cause of death.

First failure to report a drug overdose death results in a civil penalty of $500.00.

Second failure to report results in a civil penalty of $1,000.00.

Third failure to report results in a civil penalty of $5,000.00 plus a twelve (12) month suspension of the person's professional license, with license restoration available upon payment of fines and meeting other requirements.

The Mississippi Bureau of Narcotics shall assess penalties after providing written notice and a hearing, and shall receive and expend collected funds in accordance with Department of Finance and Administration rules.
