MS HB1264

Establishes the "Mississippi Terroristic Threats Law" creating a new felony offense for making terroristic threats in Mississippi.

Defines "terroristic threat" as a threat to commit a crime of violence or cause bodily injury with intent to terrorize, harm, intimidate, or disrupt a governmental function.

Makes it illegal to make a threat causing reasonable expectation of imminent offense with intent to intimidate civilians, influence government policy, affect conduct of institutions or government, or threaten murder, assassination, or kidnapping.

Provides that lack of actual intent or capability to commit the threatened act is not a defense, nor is it a defense that the threat was not made directly to the intended victim.

Imposes felony punishment of up to 10 years imprisonment for conviction, effective July 1, 2018.
