Beginning July 1, 2018, the Mississippi Department of Transportation (MDOT) personnel actions are exempt from State Personnel Board rules, regulations, and procedures, with all MDOT employees classified as nonstate service.

The MDOT Executive Director must consult with the Office of the Attorney General before taking personnel actions to ensure compliance with applicable state and federal law.

Any state agency with exempted personnel actions must file annual reports to the Lieutenant Governor, Speaker of the House, and legislative committees detailing salary increases, employee dismissals, and new hires with starting salaries.

The exemption applies to current employees; any employees hired after the effective date must still meet State Personnel Board criteria for employment.

The act takes effect July 1, 2018.
