Requires law enforcement agencies to obtain a search warrant based on probable cause before using a cell site simulator device to collect location information, stored data, or transmitted data from a communications device.

Allows warrantless use of cell site simulator devices only when law enforcement determines probable cause exists that a person committed an act of terrorism and exigent circumstances require use to prevent imminent loss of life or bodily injury, with use ending after 24 hours or warrant denial, whichever comes first.

Prohibits law enforcement from using, copying, or disclosing data collected from non-target communications devices, requiring deletion within 48 hours for warrant-authorized use or 24 hours for warrantless emergency use.

Defines "cell site simulator device" to include IMSI catchers and other devices that intercept, collect, access, or obtain data from communications devices through active or passive means, excluding electric utility devices used solely for measuring usage or operating the grid.

Amends sections 41-29-701 and 41-29-513 to require that any application to use a cell site simulator device must be accompanied by a search warrant issued in accordance with the act's requirements, effective July 1, 2018.
