Attorney General must compile by February 1 annually a list of prescription drugs essential for treating diabetes (including all insulin and biguanides) with their wholesale acquisition costs.

Attorney General must identify drugs on that list with wholesale acquisition cost increases equal to or greater than the Consumer Price Index Medical Care Component increase in the prior year, or twice that increase over two years.

Manufacturers of listed drugs must submit reports by April 1 annually including production costs, administrative expenses, profits, patient assistance amounts, wholesale acquisition costs, five-year price history, and rebates provided to pharmacy benefit managers.

Manufacturers must submit additional reports by April 1 for drugs with significant price increases, detailing all factors contributing to the increase and their respective percentages of the total increase.

Pharmacy benefit managers must report by April 1 annually on total rebates negotiated for listed diabetes drugs, amounts retained, and rebate amounts by coverage type (Medicare, Medicaid, governmental and non-governmental third parties).
