House Bill 827 Summary

• Allows owners of manufactured or mobile homes to permanently retire the title to real property by filing a recorded affidavit of affixation with specific information about the home, property, and any liens, then submitting the affidavit to the Department of Revenue.

• Exempts manufactured homes with permanently retired titles from county registration requirements and allows owners to satisfy utility service requirements by providing either a registration certificate or a certified copy of the recorded affidavit of affixation with Department of Revenue confirmation.

• Establishes procedures for severance of a manufactured home from real property through an affidavit of severance, allowing issuance of a new certificate of title if the owner wishes to detach the home.

• Requires the Department of Revenue to maintain permanent records of all affidavits of affixation, manufacturer's certificates of origin, surrendered titles, and affidavits of severance related to manufactured homes.

• Sets a $9.00 application fee for retirement, destruction, or severance of title to manufactured homes and clarifies that manufactured homes with retired titles shall not receive new certificates of title unless title is severed from the real property; effective January 1, 2019.
